President issues three new laws and one resolution

Hanoi (VNA) - The Presidential Office on June 25 announced the State President's order to issue three new laws and one resolution.

They are the revised Law on Promulgation of Legal Documents, the Law on
Atomic Energy, the Law on Amendments and Supplements to a number of articles
of the Law on Vietnam People's Army Officers.

The order also involves a resolution giving foreign individuals and
organisations the right to buy and own apartments in Vietnam .

The revised Law on Promulgation of Legal Documents has 12 chapters and 95
articles. The second article of the revised Law stipulates that a number of
authorised agencies may issue legal documents in one form of document.

Accordingly, the Government will issue decrees and the Prime Minister will
issue decisions while ministers, heads of ministerial level agencies, the
Director of the Supreme People's Procuracy and the Chief Judge of the
Supreme People's Court will issue circulars.

The Atomic Energy Law stipulates the development and application of atomic
and radiation energy, radiation technology and nuclear technology and the
safety and security of radiation and nuclear sectors.

Both the revised Law on Promulgation of Legal Documents and the Atomic
Energy Law will come into effect on January 1, 2009.

The Law on Amendments and Supplements to a number of articles of the Law
on Vietnam People's Army Officers will become effective on July 1, 2008.

The resolution enables foreign individuals and organisations to buy and
own apartments in housing development projects in Vietnam . The purchase
and ownership of houses which are villas and private houses are not yet
permitted.

The resolution defines that foreign individuals can own apartments for a
maximum of 50 years and the owners can use apartments for their living
purposes only, not for leasing or using for other purposes. The owner can
only own one apartment when they are inherited or presented with houses
besides their current apartment.

According to the resolution, expatriates are obliged to sell or donate
their apartments within one year from when their ownership certificates
expire.

Foreign-invested businesses are permitted to buy and own one or a number
of apartments in housing development projects and are allowed to own
apartments for a time equivalent to their investment duration written in
their investment licenses.

The resolution will take effect on Jan. 1, 2009 and will be implemented on
a trial basis for five years. When the resolution ceases to be effective,
owners are still permitted to own apartments as stated in their ownership
certificates and implement their obligations and tasks in accordance with
Vietnam 's law.-Enditem
