Lawyers discussed legal policy concept

Almaty, November 27, 2009 (Khabar) - In Almaty, the judicial community’s representatives of authority and legal scholars have discussed topical issues. They are on the development of the legal framework of Kazakhstan in relation to the concept of legal policy which is designed for the next 10 years.

Kairat Mami, Prosecutor General of Kazakhstan:
- Special attention was paid to the development of the administrative legal sector which deals with a wide range of problems. The approval of the administrative code of judicial practice is relevant today as it enables administrative legal proceedings to assert themselves as an independent direction of legal procedures. Also, the work of the public prosecutor’s office will be aimed at the protection of the rights and liberties of individuals and special stress will be laid on criminal as well as civil legal areas of the protection of the rights of citizens.

The chairman of the Supreme Court Musabek Alimbekov gave his support to Kairat Mami by stating that Kazakhstan should switch to restorative justice. He noted that the legislation in power allows for interpreting its norms in two ways and subjectively. The real practice of the courts indicates that 30% of common cases scrutinized by the courts are disputes relating to transactions and the fulfillment of commitments to them.

Musabek Alimbekov, chairman, Kazakhstan Supreme Court:
- The European norm for improper fulfillment of contractual obligations gives rise to new obligations whereas our legislation states that a person is brought to justice for it in which case we have to seek for the principle of guilt. Defining the principle of guilt is additional grounds for the court where certain subjective approaches of the process of administration of justice can be found.

The chairman of the constitutional council Igor Rogov reminded everyone of the fact that the concept of policy of law will take effect from the 1st of January.

- The commencement of the concept’s operation coincides with Kazakhstan starting to perform its functions as the OSCE chairman. In my opinion, it’s quite symbolic. At the same time, it vests jurists with great obligations in the implementation of this concept.

24 reports were allowed for the conference participation. The issues of constitutional rights, improvement of oil legislation and the legal status of individuals were discussed among others at the forum. The most significant remarks and recommendations are expected to be brought to the attention of the corresponding state structures.
