TWO BRIMOB MEMBERS SENTENCED TO DEATH IN ROBBERY CASE
Magelang, Indonesia, Apr 1 (ANTARA) - The district court in Mungkid, Magelang, Central Java, on Thursday sentenced police Mobile Brigade (Brimob) members, brigadiers Kusdarmanto and Syamsul Bahri, to death for killing three people when they robbed a cash carrying car.
The two defendants were proven to have violated Article 340 of the Criminal Code on pre-meditated murder in connection with a heist they carried out on a cash carrying car belonging to PT Kelola Jasa Artha of Yogyakarta on the Magelang-Yogyakarta road that caused the deaths of three people in the car.
Chief judge Adi Hernomo said the defendants were proven convincingly having committed a premeditated murder as prosecutors had charged.
The judges said the act of Kusdarmanto was sadistic, namely shooting within a close range the heads of the victims including Brigadier Murdiono also a Brimob member that led to their death.
Although he did not shoot the victims, Syamsul Bahri alias Edy Batak, took part in the planning, agreed with it and helped the killing.
"No factors help reduce the sentence," Hernomo said.
In response to the ruling, Kusdarmanto and Edi Batak said they would appeal.
"The sentence is too harsh, made without considering our defense. What my clients did was not a premeditated murder. The aim was robbery and (the killing is ) for easing the operations. The judge should apply Article 339 instead because the killing was done spontaneously," the defendants' lawyer, Agus Joko Setiyono, said after the session.
The police have already fired Kusdarmanto.
The heist took place in September 2009. Three passengers of the car namely Brigadier Murdiono, Agust Sutrisno and Arif Wirahadi, employees of PT Kejar, died with shot wounds on their heads.
Although they had killed the victims the defendants failed to collect the Rp2 billion cash money in the car because people immediately came to the scene to help the victims.
