PETROPAVLOVSK-KAMCHATSKY, July 29 (Itar-Tass) - The Kamchatka
Territory Court after considering a cassation appeal has upheld a sentence
of the Petropavlovsk-Kamchatsky court passed on Japanese citizen Takagiwa
Matsuo, the captain of the Tomi Maru 53 ship that was detained for
poaching in Russian waters in autumn 2006, the Prosecutor's Office of the
Kamchatka Territory told Itar-Tass on Wednesday.
Takagiwa Matsuo was fined 500 thousand roubles "for power abuse
resulting in the infliction of considerable damage on the interests of the
state protected by law and grave consequences." The court decision has
entered into force, the oversight body said.
In the period from October 9 to November 2, 2006 the Tomi Maru 53 ship
owned by the Japanese company Kanai Gyogyo, without the fishing permission
caught in the RF exclusive economic zone more than 105,000 tonnes of fish
of various species. The catch was hidden. The damage to the water
biological resources was assessed at more than 9.3 million roubles.
Under the initial court decision of May 12, 2009, the owner of the
poacher ship was obligated to totally compensate the damage, and the ship'
s captain was sentenced to a fine. The Japanese side's lawyers appealed
the court decision in a court of superior jurisdiction. On July 28, the
cassation instance of the Kamchatka Territory Court considered the appeal
of the lawyers and made a decision to uphold the earlier court ruling.
