Legal Framework On Sexual Crimes Against Children To Be Tabled In Cabinet Meeting
KUALA LUMPUR, Oct 5 (Bernama) -- A draft of a legal framework on sexual crimes against children will be tabled in the Cabinet meeting before taken to the Attorney General's Chambers for drafting of the Act.
Minister in the Prime Minister's Department, Azalina Othman Said said the proposed legal framework which has been completed was presented to all members of the Task Force On Sexual Crimes in its meeting, here Tuesday.
"The proposed legal framework comprise of provisions on various sexual crimes against children such as child pornography and online and offline child grooming," she said in a statement here, Tuesday.
Azalina said, the taskforce, which she headed, had conducted a comparative study on the international legal framework to ensure that the legal framework is in line with international best practices and meet the current needs.
"In order to keep up with the recent development in international legal practice, a proposed division on the abuse of the position of trust will be incorporated in the framework."
She said a special provision on the admissibility of hearsay evidence in criminal proceedings in court would also be included in the proposed legal framework.
"The proposed new Act is to ensure a holistic Act in dealing with sexual crimes against children. More input from stakeholders and non-governmental bodies will be gathered to ensure that the government's intention to give protection to children will be achieved."
Azalina said in order to ensure an effective prosecution of perpetrators, a comprehensive approach should be taken in implementing the Act.
Consideration would be given to outdated evidentiary rules that would hamper a successful prosecution and a lengthy time frame in conducting the prosecution.
"It is noted that a specialisation amongst prosecutors, judges and magistrates is needed in dealing with sexual crimes against children," she said.
Among those present at the meeting Tuesday were representatives from the Attorney General's Chambers, the Ministry of Women, Family and Community Development, the Royal Malaysian Police, and the National Council of Women's Organisation.
