Akmed Zakayev to remain at large before extradition decision.
WARSAW, September 18 (Itar-Tass) -- Akmed Zakayev to remain at large
while waiting for the decision on his extradition. Warsaw's Court refused
on Friday night the prosecutor's request to arrest him.
"The decision of the court is not final, and the prosecutor may argue
it in an appeals instance," press secretary of the court Wojciech Malek
said. Zakayev is at large and may leave the country, he added.
"It may be possible that if the case of extradition is started, but a
request has never been received, he will come for the hearings," he said.
"Poland should respect the rights of other members of the European
Union," the Court said and referred to a UK court's decision.
"The fact that Zakayev got a status of a refugee in the UK is
non-disputable," Judge Petr Skhab said. "Beyond all doubt, a decision of
one EU member-country is valid for the whole of the European Union."
The court will not initiate any preventive measures for Zakayev, like
guarantees or a bail.
Earlier, prosecutor's press secretary Monica Levandowska said "there
should be most strict measures for Zakayev, i.e. an arrest."
"It is important for us that in this delicate case the procedure of
extradition is done precisely and the possibly soonest way," she said. She
explained this position by the character of claims presented in the
international incrimination order.
Zakayev was put on the international wanted list nine years earlier.
He was accused in Russia of committing major crimes like murders,
kidnapping, organisation of armed riot and participation in it with the
purpose of changing the Constitutional order and breaking the territorial
integrity of Russia. He was also accused of terrorism and other crimes.
Totally, he is accused of eleven criminal episodes.
Back in 2002, Zakayev was detained in Copenhagen in accordance with a
request from Russia, and spent 34 days arrested there. Denmark refused
Moscow's request, and Zakayev was liberated. Later on, he was arrested in
the UK. That country also refused Russia to extradite him and in 2003 he
got a status of a political refugee.
