UGANDAN AND TWO PAKISTANI MEN FOUND NOT GUILTY TO DRUG TRAFFICKING CHARGE

KUALA LUMPUR, May 26 (Bernama) -- The High Court here today acquitted and discharged two Pakistani men and a Ugandan after finding them not guilty of a drug trafficking charge.

Justice Ghazali Cha ordered the Pakistani men, Jahangir Aslam Chonan, 41, and Makhdoom Qasim, 40 , and the Ugandan, Musaazi Ivan Okorocha, 22, at the end of the prosecution case after finding that the prosecution had failed to establish a prima facie in the case.

He ordered the three men to be deported to their respective country of origin within two weeks and also banned them from entering Malaysia again unless with a court order.

The three men were charged with trafficking in 1,160gm of heroin and 126.99gm of Monoacetylmorphine in the vicinity of a KFC outlet at Jalan Raja Laut at 5.30pm on March 10, 2008.

In his judgment, Ghazali said there were uncertainties in the markings of the case exhibits, colour and weight of the drug that was seized, and also on the charge where the joint intention of the three accused was not stated in the charge.

He said there was also a third party, involving two Africans, N. Guesan Jean and Obeik Keneth, who were not jointly charged for the alleged offence, despite Guesan having USD27,000 (about RM82,000) in his possession when arrested.

The other man was detained under the Immigration Act, he added.

Meanwhile in JITRA, a Nigerian student was charged in the Magistrate's Court with two counts of drug trafficking.

Emmanuel Muwonge, 29, is charged with trafficking in 43 pallets containing 804.92gm of heroin at a road side near the Tanah Merah Petronas oil station at about 11.55pm on May 14 this year.

He is also charged with trafficking in 15gm cannabis at the same place and time.

Magistrate Ahzal Fariz Khairuddin set July 34 for mention.

Deputy public prosecutor Nurul Huda Idris prosecuted, while Muwonge is represented by lawyer K.T. Jayaraj.
