ABOUT CONTRIBUTION TO RECOMMENDATION’S IMPLEMENTATION OF UN CRPD COMMITTEE

Ulaanbaatar /MONTSAME/ A Mongolian "Tegsh Niigem" NGO for the disabled reported on Monday about the implementation of the Recommendation on realization in Mongolia of the UN Convention on the rights of the persons with disabilities (CRPD) and its Optional protocol, given by the Convention Committee. Mongolia ratified UN Convention on the rights of the persons with disabilities (CRPD) and its Optional protocol in May 13 of 2009. Initial Country Report on the implementation of CRPD was sent to the CRPD Committee by the Government of Mongolia in 2011. The Committee considered the initial report of Mongolia (CRPD/C/MNG/1) at its 188th and 189th meetings (CRPD/C/SR.188 and 189), held on 8 and 9 April of 2015, respectively, and adopted the following concluding observations at its 199th meeting (CRPD/C/SR.199) April 16. The CRPD Committee made 37 recommendations, three demands and one request to the Government of Mongolia, and made its observations and conclusions to the General principles and obligations regarding Article 1-4 of the Convention: The CRPD Committee was concerned that while the State party adheres to the World Health Organisation (WHO) concept of disability with a focus on conditions arising from inherent personal or medical impairment, it overlooks interactions with environmental factors. While the Convention recognizes an evolving concept of disability, the State party appears to be trapped by the concept of a ‘permanent disability’. The Committee is concerned that the State party’s legislation and policies on persons with disabilities are not harmonised and do not adequately reflect the inter-dependent aspects of the each article with other articles. The Committee recommended the State party to Harmonize its national legislation and policies to ensure full compliance with the Convention and the inter-dependent aspects of its provisions, and adopt the human rights model of disability that stress human dignity of persons with disabilities and conditions arising from interactions with various barriers that may hinder their full and effective participation in society on an equal basis with others; and Develop a strategy for implementation with clear structures for policy co-ordination, benchmarks, timelines and appropriate funding. The Committee requested from the Government of Mongolia to provide, within twelve months and in accordance with article 35, paragraph 2 of the Convention, written information on the steps undertaken to implement the recommendations contained in paragraphs 32 and 46, which are: 32. The Committee recommends that the State party develop a de-institutionalisation plan, in consultations with persons with disabilities, which includes establishing support measures, including personal assistance to persons with disabilities, regardless of whether they have family or not. 46. The Committee recommends the State party repeal legal provisions which deny or restrict the right to vote based on disability and develop appropriate legal measures to ensure persons with disabilities can fully participate in elections and public life as citizens, voters and/or candidates. The Committee requested the State party to submit its combined second and third periodic reports by no later than 13 June 2019, and to include therein information on the implementation of the present concluding observations. The Committee invites the State party to consider submitting the above-mentioned reports under the Committee’s simplified reporting procedure, according to which the Committee prepares a list of issues at least one year prior to the due date set for the report/combined reports of a State party. The replies of a State party to such a list of issues constitute its report. To implement the above-mentioned Recommendation, national Disabled People’s Organizations gathered in May 6 and 7 in Ulaanbaatar hotel, joining their efforts and voices to contribute to the development of the Plan of Action for next 4 years. The planned activities will be developed on the basis of non-discrimination of persons with disabilities according to their disabilities and reasonable accommodation in order to provide full and efficient participation in the society. The workshop was organized within the EU and AIFO co-financed project “To protect the rights of the persons with disabilities through capacity building of the civil society organizations” (EIDHR/2013/316-059) being implemented by “Tegsh Niigem” NGO.
