Vagrant Gets 4 Years Imprisonment for Daesh Material
KUALA LUMPUR, Oct 10 (Bernama) – A vagrant was sentenced to four years in prison by the High Court here today for possession of Daesh material.
Hasbullah Hassan, 38, pleaded guilty before justice Mohd Sofian Abd Razak to having 13 videos and eight photographs related to Daesh in his mobile phone, at Lebuh Ampang here, at 12.20 pm on Jan 29.
The charge under Section 130JB(1)(a) of the Penal Code carries maximum seven years imprisonment or a fine on conviction, and liable to forfeiture of any assets related to the offence.
Earlier in mitigation, the single father of two who was unrepresented, submitted that it was his first offence, was remorseful and would not repeat it. He told the court he did not know it was wrong to possess the material until the police arrested him.
“Just because I was in possession of the material did not mean that I supported Daesh..I only wanted to watch, but this will serve as a lesson to me,” he said, telling the court that he also suffered from health problems and had a growth on his spine.
However, deputy public prosecutor Munirah Shamsudin@Baharum urged the court to mete out an appropriate punishment considering the seriousness of the crime which could spread like cancer and detrimental to society if uncurbed.
According to the facts of the case, Hasbullah was arrested by a police team in the vicinity of the HSBC building in Lebuh Ampang. A white coloured Samsung mobile phone registered under his name was found on inspection to contain 13 videos and eight photographs related to Daesh.
