MK NOT TO DELAY HEARINGS ON ELECTION-RELATED CASES : CHAIRMAN
Jakarta, May 18 (ANTARA) - The Constitutional Court (MK) will not delay its hearings of lawsuits over the legislative election results so as to settle all of them by June 24, 2009, MK Chairman Mahfud MD said.
"There will be no delay in hearing the lawsuits. We have received a total of 620 cases and we hope all of them will be processed on schedule," the MK chairman said here on Monday.
Therefore, he said, all parties who had filed lawsuits and those who were sued should prepare all the necessary things needed in the court sessions.
"There will be tolerance for the excuse of 'we are not-yet ready'. If the sued party is not yet ready, MK will rule in favor of the party who filed the lawsuit. If the party who filed the lawsuit is not yet ready, the MK will throw out the suit," Mahfud MD said.
He said all decisions to be taken by the MK would be based on evidence and facts presented in the court sessions. "If the arguments presented in a court session cannot be substantiated with evidence, the lawsuit will be terminated," the MK chief said.
On Monday, the Constitutional Court heard 16 cases of lawsuits related to the outcome of the legislative elections held last April 9.
The MK said its Monday hearings were the first it was holding on disputes on the results of the recent legislative elections.
In the first court session, the MK dealt with most lawsuits filed by candidates of Regional Representatives Council (DPD), namely 12 cases from, among others, Nanggroe Aceh Darussalam, Papua, East Java, and Lampung.
The MK also dealt with lawsuits filed by three political parties, namely the Indonesian Love Democracy Party (PKDI), the Indonesian Youth Democracy (PPI) and the Indonesian Democracy Upholders Party (PPDI). ***
