AGO TO NOTIFY PRESIDENT WHEN ANTASARI TAKEN TO COURT
Jakarta, Aug 27 (ANTARA) - The Attorney General's Office (AGO) said it would send a letter to President Susilo Bambang Yudhoyono after Antasari Azhar's dossiers had been submitted to the court.
"The letter to the president will be sent after Antasari Azhar has become a defendant in court. At present, Azhar has not yet become a defendant," AGO spokesman Jasman Pandjaitan said here on Thursday.
Jakarta police investigators had earlier handed over the case (evidence and suspects) in the murder of PT Putra Rajawali Banjaran (PRB) President Director Nasuriddin Zulkarnaen to the South Jakarta Public Prosecutor's office.
The suspects in the case are Antasari Azhar (suspended chairman of the Corruption Eradication Commission (KPK), Senior Commissioner Wiliardi Wizard (former chief of South Jakarta Police), Sigit Haryo Wibisono (a boss of a national print media publication) and Jerry Hermawan (the middle man in the murder case).
The president is still waiting for an official letter from the police and the KPK on Azhar's status before the head of state could issue a presidential decree definitively discharging Antasari as KPK chairman.
The AGO spokesman said that a suspect became a defendant after he or she had been taken to court. He said that based on criminal code procedures, a defendant was a suspect who was being prosecuted, examined and tried in a court trial.
"Intended as a prosecution is not the process when the demand for a punishment is read but when the dossiers (for the trial) are handed over to the court," Pandjaitan said.
The criminal code procedures specified that prosecution is the handing over of a criminal case to the district court.
"At present, Antasari Azhar has not yet become a defendant, but in administrative term, he can be said to have the status of a defendant," he said.***
