The Office of General Prosecutor asks the European Court on Human Rights to hasten decision on Amir Kabulov’s complaint.
Astana, October 15, 2009 (Khabar) - The main supervising department representatives have told about the case of Kazakhstani citizen who is under commitment in Ukraine during 5 years. In 2004 Amir Kabulov has been detained by law enforcement bodies of Ukraine on suspicion in murder fulfilment in territory of Kazakhstan. Kabulov has addressed the complaint to the European court on human rights. It has suspended process of his extradition to home. Kazakhstani citizen waits for the decision of the international court in an investigatory insulator of the foreign state. Under the Kazakhstani laws term of the maintenance of the person under arrest at a stage of pre-judicial manufacture cannot exceed twelve months. The petition with the request to accelerate a legal investigation has directed to the international court in order to protect Amir Kabulov's rights.
Nurdaulet Suindukov, official representative of the Office of General Prosecutor:
- As soon as the European court will accept the final decision under this complaint the question on his extradition to Kazakhstan will be renewed and only after his returning to Kazakhstan process on the criminal case of Kabulov also will be renewed. Stay term under ex-traditional arrest in territory of the foreign state is set off at appointment of punishment definitive by a court sentence, but at the same time the doubts raises, whether that period when he expected the decision of the European court will be included.
Officials also have told about infringements that were indicated during the check of children’s rest establishments. According to Office of Public Prosecutor, in a number of summer camps a sanitary code and safety rules was regularly broken, because of negligence of leaders in Kostanai area one child died and three were hospitalized. Nurdaulet Suindikov also has paid attention to a problem of safety of side-shows: their work is not regulated by statutory acts, at the same time for 6 months 29 children got traumas on attractions.
