Discussion of changes in criminal code

Astana, October 16, 2009, Khabar - The new concept of legal policy to 2010-2020 years was developed and approved by the head of the state. Within this document it is expected to make changes almost in all directions of state law: from civil to bank. Particularly the issue of strengthening of juridical person’s responsibility was discussed. Earlier if the firm or company breaks the law its head was called to answer, and the organization continued its work. Now with the approval of new norms the company will be liquidated or obliged to pay big penalty.

Sattybek Ongarbayev, vice-chairman, Agency of struggle against economical and corruption crimes:
- The property of these persons usually is not enough to cover the state’s losses. Connected to it when the responsibility of juridical person would be stated then the property will be returned to government through this juridical person.

Also it was said that the principle of inevitability for any crimes and rights restriction on the example of the USA should be introduced. This norm will help the effectiveness of legal system. And the amount prisoners will decrease. Moreover now the criminal law-making will be electoral. More humanistic and loyal measures will be taken to definite categories of people.

Kairat Mami, General Prosecutor of RK:
- Humanization of criminal policy, decriminalization of some crimes of small or average weight, liberalization of law for those who committed crime for the first time, for people under age, women and elders are introduced. At the same time the second vector is the strengthening of punishment for serious crimes and recidivisms.
