Mumbai, May 7 (PTI) Controversial encounter specialist
Pradeep Sharma, who was dismissed by Mumbai police for his
alleged links with underworld gangs, was Thursday ordered to
be reinstated by the Maharashtra Administrative Tribunal which
held that his removal was unsustainable under law.
48-year-old Sharma, an Inspector with the Mumbai police
who has killed 112 criminals in 25 years of service, was
dismissed from the force by the Maharashtra Government on
August 31 last year for his alleged links with the crime
syndicate.
Sharma was accused of corruption and amassing wealth to
the tune of a whopping Rs.3,000 crore. He was suspected to
have ties with gangs led by Chotta Rajan and Dawood Ibrahim.
Sharma has denied the allegations.
"The tribunal today issued directions to the DGP
(Director General of Police) ordering him to reinstate Pradeep
Sharma and also ordered payment of back wages for the period
since his dismissal," Sharma's lawyer, Sandeep Mutalik told
PTI.
The order did not however specify a time limit by when
Sharma should reinstated, he said.
"He was dismissed under Article 311 2(b) of the
Constitution and a departmental inquiry had been dispensed
with prior to the dismissal," Mutalik said.
"We also challenged the other allegations levelled
against him (Sharma) and argued that police should have stuck
to procedure by filing a chargesheet against him, he said.
"In its order, the MAT has ruled that the dismissal order
was unsustainable under law and if required the police could
proceed with an enquiry in which Sharma would also be allowed
to present his arguments," Mutalik said.
Sharma's dismissal from the force eight months back came
after police claimed to have intercepted telephonic
conversations he is believed to have had with criminals.
Refuting the charges, Sharma had accused the Chotta
Rajan gang of framing him. Chotta Rajan's henchman, Kamalakar
Satardekar fell to Sharma's bullets in an encounter killing
in June, 2004, becoming the 100th criminal to have been
